Fixed-fee, lawyer-supervised transfers — with the duty and lender position settled before signing.

Transfers between family members

Spouse to spouse, parent to adult child, sibling to sibling, gifting and inter-generational restructures. Each is dutiable unless a specific exemption applies; we confirm the position before the transfer is signed.

After separation or divorce

Transfers giving effect to a Family Court order, Binding Financial Agreement, or consent orders. Where the qualifying conditions are met, the transfer is exempt from Victorian stamp duty — but the documents and timing have to be right.

Trust, company and SMSF transfers

Into or out of discretionary trusts, unit trusts, family companies and SMSF bare trusts. We check the trust deed authorises the transfer and that the duty position (concession, full duty or transfer of dutiable property) is documented correctly.

Deceased estate transfers

Survivorship applications and transfers from a deceased estate to a beneficiary under a will or intestacy. Coordinated with the executor and the probate or letters of administration, and lodged through PEXA.

Name changes and corrections

Updating the registered proprietor's name after marriage, divorce or change by deed poll, and correcting historical errors on title. Lodged with the Registrar of Titles with the supporting evidence required.

Mortgagee and lender requirements

Where a mortgage is registered, the bank must consent. We obtain the discharge, coordinate any new loan, and align the transfer and security registration in a single PEXA workspace.

Stamp duty

SRO assessment, before lodgement.

We assess whether a Victorian exemption or concession applies (spouse, Family Court order, principal place of residence, deceased estate) and lodge the appropriate Digital Duties Form with the supporting valuation evidence. Lender consent

Discharge and re-registration.

Where the property is mortgaged, the existing lender's discharge and any new lender's mortgage are coordinated in the same PEXA workspace as the transfer. The bank signs off in writing before the transfer is signed.

PEXA lodgement

Electronic, with proof of registration.

The transfer is lodged electronically through PEXA with Land Use Victoria. You receive written confirmation once the new title is issued in the correct names — usually within a few business days.
